Mediation


Mediation is an art form that combines intuition, subtlety and vision. Mediation is a process that takes place in predictable steps. By understanding these steps in the process, you can better manage the process. Appointment is in view; the goal is for all parties to have a solution where they can live and where they can rely. It focuses on solving problems, not by removing the truth or imposing legal principles. This is of course a very different approach than the judges take. In court, a judge or jury looks to find out who is right and who is wrong and then requests a fine or reward on the basis of his decision. Guideline for efficient mediation describes mediation as a voluntary process whereby the third party assists two or more parties in their consent to prevent, manage or resolve a conflict by helping them to develop acceptable agreements.

This is a procedure whereby an arbitrator without arbitrary authority (the mediator) systematically facilitates communication between parties with the aim of enabling parties to accept their responsibilities to resolve their dispute. Additional key features are the confidentiality of the scheme and the neutrality of the mediator.
In mediation, two or more people come together to try and find a solution to their problem. A neutral third person, called the mediator, was there to help them. Most intermediaries have some training in solving the quarrel, although the degree of their training varies. Unlike a judge or an arbitrator, the mediator does not make decisions or take decisions. It is the task of the mediator to assist disputants in evaluating their goals and choices and to find their own mutually satisfactory solution.
